Single Status Affidavit

A Single Status Affidavit is a document confirming the single status of a U.S. citizen or a Vietnamese national residing in the U.S., typically a green card holder.

This affidavit is certified and legalized by the Vietnamese diplomatic mission in the U.S.

It is required for those with green cards who wish to marry a Vietnamese citizen in Vietnam. Although not mandatory, obtaining this affidavit before returning to Vietnam is recommended.

Processing Time: Approximately 4-10 weeks

Fiancé(e) Visa (K1 Visa)

The fiancé(e) visa (K1 visa) is a non-immigrant visa issued to the fiancé(e) of a U.S. citizen to enter the U.S. with the purpose of marriage.

Conditions:

The fiancé(e) must marry the U.S. citizen within 90 days of entering the U.S. and must file for a change of status (green card application) to stay and work legally.

Only U.S. citizens can sponsor a fiancé(e); permanent residents cannot.

The couple must have met in person at least once in the past 2 years.

The sponsor must demonstrate financial capability. If not sufficient, a financial sponsor can be used.

Processing Time: 3-9 months for USCIS approval, followed by a visa interview at the U.S. consulate.

Spouse Visa

For those married in Vietnam or the U.S. and wishing to sponsor their spouse to stay legally in the U.S.

U.S. citizens can sponsor their spouse under the CR1 or IR1 visa categories. CR1 is for marriages under 2 years, while IR1 is for marriages of 2 years or more.

Permanent residents can also sponsor their spouse, but the process involves a priority wait in the visa bulletin after USCIS approval.

Processing Time: 1-2 years or longer, depending on USCIS processing speed, additional documentation, and case complexity.

Parent Sponsorship

The IR5 visa allows U.S. citizens to sponsor their parents for permanent residence.

Conditions:

The sponsor must be a U.S. citizen and at least 21 years old. Permanent residents cannot sponsor parents.

Income requirements vary by state, family size, and number of dependents. If income requirements are not met, assets or a financial co-sponsor can be used.

Child Sponsorship

U.S. citizens can sponsor their children for immigration to the U.S.

Categories:

Children under 21 years old.

Unmarried children over 21 (F1 priority).

Married children (F3 priority).

Conditions:

Must be a U.S. citizen or permanent resident.

Income requirements vary. If not met, assets or a financial co-sponsor can be used.

Sponsoring Siblings

U.S. citizens can sponsor their siblings for immigration under the F4 priority category.

Conditions:

The sponsor must be at least 21 years old and a U.S. citizen.

Proof of sibling relationship is required, including biological, step, or adoptive relationships.

Transition from 2-Year to 10-Year Green Card

A 2-year conditional green card is issued to those who marry (less than 2 years) or invest under the EB-5 program.

Conditions include maintaining marital status or meeting investment requirements, and not leaving the U.S. for more than 6 months per year.

To transition to a 10-year green card, an application must be submitted 90 days before the 2-year card expires.
10-Year Green Card: Permanent residency for those meeting employment, marriage (over 2 years), or family reunion criteria.

Fiancé(e), student, and tourist visas can be adjusted to apply for green cards and work permits after marrying a U.S. citizen or permanent resident. The sponsorship application can be filed in the U.S., allowing legal residence and work during the application process.
